Most carriers can write a group with as few as two enrolled employees, and small-group rules generally cover businesses from 1 to 50 employees. Participation and contribution requirements vary by carrier, so the practical answer depends on your team. If a traditional group plan does not fit yet, an ICHRA has no minimum participation requirement.
The working floor is usually about half of the employee-only premium, since that is what most carriers require and also what the federal Small Business Health Care Tax Credit requires for employers that qualify. Beyond the floor, what you fund is a hiring decision: employers competing for skilled staff often cover most or all of the employee tier.

No state law requires a small Utah employer to offer health insurance. The federal ACA employer mandate only applies at 50 or more full-time equivalent employees. Most of the owners we work with offer coverage because it wins hiring and keeps good people, not because a statute requires it.
